Say, there seems to be some confusion over the which is the SKIL bill and which is the Comprehensive Immigration Reform Act (CIRA).
GovTrack lists the Comprehensive Immigration Reform Act as S.2611, sponsored by Sen. Arlen Spector. This was the bill that the Senate passed on 05/25/06. OK easy enough.
If I do a search for securing knowledge innovation in GovTack, S.2691 pops up, sponsor Sen. John Cornyn. OK all good.

Hello?
I entered U.S with B1/B2 visa and got changed into F1 status. While F1 status got approved
I departed U.S due to family matter.
Now I'd like to make it sure that my B1/B2 visa is still valid,because I plan to visit to my friend who lives in U.S.
How to check my B1/B2 visa could be remained still valid?
Or does somebody know anybody who had been in same situation?

Hi,
I am being told by my employer that Prevailing wage applies for the hours from the start of an employment to the end of the year irrespective of any vacations.
I joined my current company in Feb 2010 and went to India for 1.5 months in Oct-Nov and came back, My prevailing wage hours is calculated from Feb 2010 till the end of the year ignoring the break I took when in India. So, even if I am paid for only the hours I worked here, I have to match the Prevailing wages based upon the hrs from Feb 10 till Dec end 2010.
They want me to pay them the difference as I had a low billing rate and my total earning is lower than the prevailing wage based upon this calculation.
I don't see sufficient information on the web for this clause.
Please help.

I had a 221g in 2000 and submitted all the docs. I got response in 2002 (After 2 years :eek:) . I had just 10 months left on my H1 that time. So we will never know. But situation in 2000 was different. I am not discouraging you but telling how hard these 221gs will be. I hope its not that bad these days and you may get response soon.

Correct me I am wrong here:
AP allows you to enter US without a valid visa.
EAD allows you to work in US for any employer.
Untill and unless someone utlizes his EAD, he is still on H1 (if he has valid H1) doesn't matter he enters US using AP. Am I correct?
Then question arrises, If H1 holder changes his job then he needs to transfer his H1 only and not use EAD. Is this possible to have H1 renewed and transfered even though one has EAD approved, meaning is it compulsory to use EAD one you get it?

I have a question about a new H1-B application while I-485 is pending. If I-485 is pending and the person is currently working on EAD with expired H1-B, is there a requirement that the person has to leave the country to apply for a new H1-B based on pending I-485? If yes, will it affect the green card process negatively?
My attorney says that as there was a gap in H1 status, one has to leave the country for a new H1 application, even though it is with the same employer.

Hello,
I was wondering how long it took for everyone's check to be cashed once their packages were received at the TX service center? I'm worried because from what I read before the check cashing was almost immediate, while getting a receipt actually took longer. My package was received and signed for by Michael Salcedo on November 13th, but the check still hasn't cashed and I do not have a receipt. My husband and I are planning on travelling to Canada for Christmas, will crossing the border be a problem? Any advice anyone can give would be great! Thanks in advance!

Should be pretty straight forward. Ask her to take the signed I-20, financial support docs, letter from the department, and also from advisor (if possible). Though in our case, the VO didnt ask for a single doc but its good to have them all.

Hello all, my Labor Cert was filed in late 2004 under the RIR regime. Was later "re-filed" under PERM in Oct. 2005. I am an EB-2 candidate (Indian citizen).
The DOL denied the application for Labor Certification filed under PERM recommending that the requirements for the position offered include the phrase " any suitable combination of education, training and experience is acceptable" The denial offers both the option of filing a motion to reconsider and refiling the application with the amended requirements. The law firm hired by my employer has filed a "motion to reconsider". In addition they are in the process of re-filing the application with the amended requirements. My question is-how quickly (from your experience) does the DOL take to respond to the motion to reconsider (my lawyers referenced a memo sent out earlier this year from the DOL in which a 3-4 month timeframe was mentioned).
