Labor category has little to do with AC21. Your responsibilties should be 'similar', which is kind of a vague term, which means USCIS would generally not mess with anything that has enough of the same words used in description.

Our Application was also received by M.Salcedo at TSC on August 2nd. We got all our receipts on October 1st. When I checked the status online for 765, the status showed - 'Card Production Ordered'

there are two choices for - I140 Filing Type
- Regular
- Premium
What is the difference b/w two. Can EB3 candidate file for I140 Filing Type in Premium category.

The Memphis Commercial Appeal reports on today's citizenship swearing in of Irish-born James Patrick O'Donnell. Mr. O'Donnell immigrated to the US at the age of 4 in 1926 and fought for our country in World War II and won a Bronze Battle Star. In 1987, Mr. O'Donnell applied for a passport to go on a cruise and was told that he was not a citizen despite his clear recollection of being naturalized before shipping out during the war. your lawyer. In many cases, the "most recent action by USCIS" counts. So your H1B gets approved and then H4 gets approved, the last action may count. That is why it is important that you consult a good attorney.

Has anyone traveled to India by Virgin Atlantic connecting to Jet Airways at London ?
The ticket is from Virgin Atlantic (through ticket, Jet is their Code Share) .
For baggage rules, Virgin website says --
"Any passengers travelling from India to the USA, (and vice-versa), with Virgin Atlantic for their entire journey, which involves a connecting flight via London Heathrow, will be entitled to an additional bag up to 23kg ."
I sent them an email before ticketing and they replied I am entitled to two piece.
When I contacted them after ticketing , they say I am entitled to one piece. Logic was London - Mumbai is by Jet Airways (but my argument is the ticket shows VS flight number).
Does any one have any experience ?

I have a question. I heard about new premium processing rule for 140.
my friend�s six years is going to complete in next month , he has applied labour certification via PARM 10 months back and its pending, did he is eligible to file 140? Or he has to live next month?

I have heard in the past from a lawyer that when in H1B status the filing of Green Card must be done and labor certification approved before the 5th anniversary of H1B status. In other words, one cannot start the process for a Green Card in the 6th year of H1B status.
Is this correct? Or is the lawyer being overly cautious?
If such a rule does exist can you please point me to the exact regulation?

My labor is approved, but haven't received approval from immigration yet. Online status is showing it is 'CERTIFIED'. Can I file I-140/485 with just electronic confirmation of labor in case if it get delayed in receiving approval? Bwy does anybody have an idea in how many days immigration will dispatch the approval copy of labor after it is certified?

Since iam nursing my son,mmr vaccination was not given to me.i saw my report and compared.In the contraindication colomn ,he checked for MMR vaccination.This means for some reasons(or if under medication) i was not given this vaccination?Did anyone experience this?will i b asked to take it ?

Hi,
I got my labor approved couple of weeks back and now attorney is filing I-140. My situation is
Job 1 : Worked from July 1st 2006 to Oct 2nd 2007 (Laid off on that date and h1b was not cancelled ever after)
so applied for h1 transfer immediately, USCIS received application on Oct 9th 2007 (Regular processing)
While I was waiting on that, I got another fulltime job in Nov, Applied for h1 through this company (Premium processing) and got approval within a week, started working from Nov 15th 2007 to till date..
In Decemeber 2007, I got approval for pending H1b from 2nd compnay too.. but never used as i was already working for Company 3.
So, In my labor requirement it was M.S. and 1 yr relevant experience, Labor approval showing employemnt history as
Job 1 : July 1 2006 to Oct 2 2007
Current Job : Nov 15th 2007 to till date
Is it a problem if it shows 1 month gap between these two jobs?

I helping my employer filling the I-129 B-1B Data collection supplement form. In Part C Question 8 Item 4:
Is this the second or subsequent request for an extension of stay that you have filed for this alien?
This application is an extension (for 3 years) for my H1-B. My position in the company is the same as that when applied for my previous (first) H1-B petition.
I have NOT applied for green card/labor certification.
Is the answer Yes or No for this question?
