I e-filed my EAD renewal application along with my wife's EAD application on 03/16 and both were approved on 04/07. We both have sequential receipt #s.
However, we received my wife's EAD on 04/12 but not mine. I am the primary application of 485.
Does this happen often ?

Can I apply for EAD for spouse on the basis of I-140 approval? I can not file I-485 due to retrogression and he is running out of her H1B visa limit.

It is possible to approve I-485 if I-140 is approvable but is not approved. One of my friends got his GC this way.

New I 140 possible in case of appeal pending on old I 140 rejection
I'VE A QUESTION REGARDING I-140 case on appeal. The original approved PERM labor certification is in that case. In order to file new I140 Whether, I need to ask USCIS to withdraw that case and use my approved labor certification for this new I-140. But I am not sure how to accomplish that. Let me know if you have any helpful info.

I am Cross Charging and applying for AOS filing. While filing do I need to provide BONA FIDE copies of Marriage & Birth certifcates. ??

Hey,
I have a 290B pending at Texas which was submitted on 20 Nov 2007. I had a LUD on 27 Nov. Nothing happened after. Based on others experience (in NSC) it is taking about 4 months for something to happen. No clue about TSC. Just sit tight and have a backup plan. Good luck.

In theory, you can be the beneficiary of 2 H-1B petitions pending at the same time. This happens fairly often. Both could be approved and then you would be eligible to work for either company as long as that approval had not later been withdrawn.

Approximately 20,000 petitions qualifying for the advanced degree cap exemption had been filed. Is it possible to obtain a Greencard from L1B status? If yes, how long does this process typically take? My understanding is it is possible and definitely easier/shorter than being on H1?

Yes , Under certain circumstances. You will either need to qualify for economic hardship, or it should be done via CPT ( it should be offered by your program). Best bet will be for you to talk to your International student advisor.

I just realized a stupid mistake was made after filing my COS from F1 to H1B. My employer sent the entire application this Monday to Vermont Premium Processing Center. I had no idea that the I-539 was not even needed and that I-129 and I-907 were sufficient enough to proceed with the COS. Anyway, is there a way to correct this error? I'm just hoping USCIS won't reject my application and just process my COS.
I included a separate check worth $300 to pay for the I-539 but the rest of the payments were issued by my sponsoring employer. I really thought I-539 was one of the requirements so I went ahead and included it.
Any input will be appreciated.

I was on F1 visa and applied for my GC / I485 thru my spouse few years back. Unfortunately while coming back from India 3 years back, I used my stamped F1 visa instead of AP. My lawyer told me that due to this, I have abondoned my AOS and he has to withdraw my 485 and refile it when it will be current. Few days back spouse became current and attorney was preparing to apply for 485 again but in USCIS the status of my application was still shown pending not withdrawn. To our surprise, we saw 2 GC in the mail and the online status was shown approved. But the attorney is saying that we should re-file the 485 since USCIS did not withdraw my application and approved it. They says that I might have issues if my absence is detected when I will apply for citizenship later. Please suggest. I am so puzzled and tensed..

she will be on EOD once she quit the Job. You may not have to file COS to H4.
My wife quit the job last year she was on H1. and we didn't get any RFE till date..
She also went to India and came back on AP this year...
