Labor, I140 approved and I-485 filed during July-07. Have EAD and AP but never used it. Still on H1B, extended for 3 years based on approved I140 and valid until Dec 2011. With my GC employer all along, employer is applying for LCA now as my new client is located in different state. My questions are:
� Whether there will be any impact on my ongoing GC process if the job description on this new LCA is different?
� If anything goes wrong with this LCA, whether there will be any impact on my existing H1 and eventually on GC process?
� If something wrong happens to my H1, can I still switch to EAD after that?
� What is the process to move from H1B to EAD within the same company, is filing new I-9 with EAD detail is suffice?

For ex Company A applies for my H1 and gets approved in May 2007 although it applies fromOct 2007. Now i get an offer from Company B before Oct 2007 say in July 2007. Can i transfer my H1 even though it starts from Oct 2007?

I got my H1 approved in Oct 2004 and it was from Oct 2004 - Oct 2007. I used only 6 months of H1 and later went on TN (work visa for Canadian citizens) and remained in US working on TN for 4 years. I was in US all these years. Now even the earlier H1 approval duration is over, Can I apply for H1 with another employer using the old 2004 H1 quota cap or it has to be under new 2009 cap? Thanks in advance.

i am in a small problem and it would be great if someone could help me out.
i came in us on f1 visa in jan2008 and i completed my mba in dec 2010. my opt expired on 31st march 2010. but before my SEVIS could expire i transfered my SEVIES to new college for summer term. now my visa is for 5 years ending on jan 2013. i know as long as i stay in US i am maintaining my status. but now i need to go home for few days. So how is it going to wrok for me? Do i need to go for new visa stamping or can i come back on same visa ? if i need to get new visa can i get it done in US before going home ? What are my option and what are my chances of coming back?

1. i applied Green Card in EB3 category, i have my EAD but iam not using it and iam maintaining my H1b for my wife as she is in H4.
2. Meantime my company is processing EB2 for me and is in PERM stage and i have included my wife in the EB2 process.
Suppose if we apply a new H1b visa for my wife and because of the tough situation if that H1b petiton is denied for my wife, will there be any queries or any issues when my wife files I-485/EAD in EB2 . Also will it cause any serious delays or I-485/EAD might get rejected?

I switched from H1 to EAD with the same employer. Due to family emergency i got to leave and may have to stay for more than 2+ months.
Would that be ok if i stay out of country while on EAD. I will be returning back using my AP.

Here is a possible scenario I might run into next year after I change employers this month and restart my GC process.
Assuming the following:
1) I have approved I-140 with new employer by Sep 2012 and I am able to port my old PD
2) My PD is Nov1 2007 under EB2. PD becomes current in Sept 2012 and I apply for I-485
3) My employment contract gets over in Nov 2012 and I have to change jobs
What happens then.
1) Will I need to change jobs based on approved I-140 ?
2) Will I be able to keep the I-485 application going ?
3) If the I-485 adjudication occurs while I am at new job and it hasn't been 180 since I filed for I485 what happens ?
4) What happens if PD retrogress in October 2012 ?

this is a bit different maybe since it deals with my mom. She was sponsored by my sister. She has been stuck in name check now for about 18 monts. Anyways, she is out of the country. She just left, and now my sister got a letter and appoinment letter for a 2nd finger print. My mother is using her advacne parole and the green card was filed for adjustment of status.
so the questiong is can my sister reschedule the appointment 8 months in the future or can she change the location for finger print to the office in the country where my mother is,
She is in Pakistan right now.

My friend had done 7th Yr Extension last month. By Mistake she gave dates such that it showed that she was out of USA for 1 year. So the lawyer filed for 3 yr extension and USCIS permitted. Is this rectifiable?
