Dear all,
Myself and my husband both have approved I-797 for H1B from different US companies.
I went for my stamping to US embassy and they asked for more evidence regarding the US company and my case is currently pending with them with all my documents ( passport, I797, marriage certificate, etc).
Now my US company is not able to get a job letter for me.
Meanwhile my husband is planning to go for his stamping. He has good evidence to support his case.
My questions are -
1.) How can I retrieve all my documents from US embassy without affecting my passport and my H1 case?
2.) If I am able to retrieve all the documents safely, can I apply for H4 with my husband`s H1 stamping?
3.) Will they create problem for issuing H4 to me because of my pending H1b case?
4.) With H4 visa and I-797 approval notice, can I start working in US ?
5.) What will be the best way out of this situation without affecting our working visas ?
Please reply if you know anything.

Matter has been discussed in the past but i wanted to get an advice/opinion from seniors/pro.
How serious problem could be leave employer in the month you get green card who has sponsored you for immigration.
I am in this situation.

Hi,
I am in US in L1 Blanket visa and is expiring on November 26th 2009.
I am planning to go back to India for renewal.
Suggest me the best option is to extend the status in US or to travel back to India for visa renewal.

Am currently in my 7th year H1 and have got admission into a parttime MBA program!
1.) I just wanted to clarify if i can accept scholarship in form of tution waivers? (not a income?)
2.) I am aware i cannot accept any scholarships which may require me working as a TA or RA? as this is a income...
but is a non-income school sponsored tution waiver an accepectable option>
Any gurus on this board like to throw some light on this!!!:confused:

The USCIS announced on June 1, 2006 that the regular H-1 cap for Fiscal Year 2007 (FY2007) was reached on May 26, 2006. Those cases properly filed with the USCIS before the 26th are safe, with respect to the cap, as there are enough cap numbers for these cases. Cases that reached the USCIS on May 26th are in an uncertain situation and will be subject to a random selection process, as there are enough numbers for some, but not all of the May 26th cases. Any regular cap-subject cases received after May 26th will be rejected entirely.This information does NOT impact advanced degree cases, for which cap numbers are still available.

While there are some politicians genuinely concerned about the subject of immigration who are backing anti-immigration laws because they believe in the cause, there are many more who have jumped on the anti-immigration bandwagon to score political points (John McCain - I'm talking to you). Hello Everyone,
I need some suggestions from you guys.
My Employer A filed my green card labor in April 2000.
I was working with them on H1B till May 2003.
I moved to Employer B on H1B in May 2003.
Employer A continued to process my GC, and they filed my I485 in Jan 2007. I paid for the expenses.
My I485 is now pending at TSC.
Also Employer A confirmed they will support till i get my GC and I don�t have to work for them.
Can I use AC21 portability to move to another employer C using my EAD?
Do you see any issues i may face since i am not working for employer A?

I filed for EAD (new application) 30 days back along with my AOS applications. Finished my FP on the 25th day.
Normally How long it take to get EAD from Texas Service center. ??
Any idea. ??
Now a days EAD is coming pretty quick. Some one got within a week. So it depends any where between 30 to 90 days.

We are looking to talk to a good immigration lawyer and seek opinions on the following
(1) H1b visa transfer process for physicians after residencies into a jobs
(2) How to handle licensing issues - murthy.com has some info, but we need a better perspective
(3) Green cards for physicians - eligibility and time frame and minimum requirements etc..
Any any other pitfalls or booby traps that one has to be careful about.
A lot of physicians do visit IV website - am wondering if there are any user groups or forums on web that discuss potential issues and other stuff that we discuss on IV.

Will there be any problem if there is any address overlap in the addresses given for the last 5 years and outside US address for more than a year.
In my 485 application, dates of India address is overlapping with US address for 1 year. Will it be a problem, if it is how to correct it since my application was already sent?
