My spouse is on H4 currently. Have applied for H1 in April 2007 and got the H1 aproved. So the new H1 starts on Oct 2007. However, we applied for 485 and got our EAD's (No recept number, No finger printing etc).
Can my spouse use EAD to start job? we dont want use that new H1 currently. What are the implications if we use EAD? Will the H1 (and my H1) be effected?

My sister filed 1-130 for me in 1997. I am currently living in the US on an H1B visa and the I-130 has been approved. As requested by the NVC, my sister submitted her affidavit of support (I-864) and paid the immigrant visa fee. However, I recently found out that I should have filed I-485 instead. I was advised that I cannot file the DS-230 because I live in the US. Is this true? Which could/should I do, DS-230 or I-485? Is there a way to get the immigrant visa fee returned?
I will appreciate any advice.

I apologize if I am asking a repeat question.
I received my green card a few months ago but my family haven't received their's yet. As a result they are still using EAD and/or Advance Parole documents. I am considering a job change and in that context I have two questions:
1. Are there any gotchas that I should be aware of - given that my family's cases haven't been approved yet.
2. If I do change jobs, can I apply for EAD and Advance Parole documents for my family on my own? Meaning, without going through the employer.

If a person travels on AP, he will get a new PAROLE I-94 which shows expiry date of 1 year from the day he entered on AP. Can the person stay in US AFTER that expiry date and continue working using a valid I-797?

Lots of activity to report. Congressional Hispanic Caucus leaders met this week with President Obama who said he wants a vote during the Lame Duck and would work the phones to round up votes. Do we (parent) gets any benefits in terms of Visa status if you have child born in USA and you stay in US for certain years?
In the other word:
Once you have child born in USA is there any way to get green card based on your child citizenship?
Once the US citizen child is an adult (I think 21 years old), then s/he can sponsor the parents for green card.
Otherwise, no.

Hello friends -
My Receipt notice states that RECEIVED DATE for my 485 is July 17, 2007 and the NOTICE DATE is September 14, 2007.
In my USCIS online account when my click on my 485 RECEIPT No. it states -"CASE recd. & pending" ...On September 14, 2007, we received this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS, and mailed you a notice......
Shouldn't this state that they recd. the case on July 17, 2007.?? Can it be true that their system is showing a recd. date of 9/14 when actually the recd. date on the actual notice/797 is 7/17/07.
How many folks are seeing this.?? Is this how it is supposed to be..I mean is it normal for them to generate a default message like this using the NOTICE DATE when you click ur case #..??

Hello,
I have already filed I-751 under removal from country results in extreme hardship,I am going through divorce process,I want to change cateogory in I-751 [marrige entered into good faith but terminated by divorce] ,so please anybody can tell me that when I will get me my divorce decree I have to refile new I-751 for cateogory change into------marriage entered into good faith but terminated by divorce.so plz help me i need to refile or just only amendment letter to uscis.if any body has gone through this process plz help me.

I received my 485 approval back in April 2008 & also received my physical card in next few months. I applied for my parents extension last month ( I-539) who are here for visit. It was filed in CA. My last H1B was approved in Oct 2007 from CA. Today to my surprise I see updates in extension case with no message change but update in my H1B approved case, with message saying that this case is reopened & the decision is being reviewed.
I think this is some kind of error. Has anyone experienced this ?

I went for visa interview in December, but my case was stuck because of administrative processing. I came back on Advance parole. I have the following questions.
1. Can I sponsor my parents visitor visa without any issue? Will the consulate quiz them/stop them because of my H-1 admin processing
2. Also is my admin processing still going on? and can I stamp my H-1 visa in the future after my case is cleared from admin processing.

I received an I-485 RFE for me and my spouse on July 28th. For the primary applicant it was Employment verification letter (currently dated letter from employer describing duties,position and salary info) and for my wife it was about proof of bonafide marriage.
My attorney replied to RFE on Aug 6th with necessary evidence and EVL.
Online status for both of us changed today Aug 10th from RFE SENT to RESPONSE TO RFE RECEIVED AND CASE PROCESSING RESUMED.
Hope this info is helpful in estimating time for people in similar situations.
