    The underwriters was OK with my H1B + I-140 Approval + I-485 Reciept.

    Thank you all for the tips and leads.

    After a long 60 day wait, I m finally getting the house on Monday. :)

    Extensions these days take less than 60 days for sure.

    Also if you have a home-country license, you can always use it as a time gap arrangement :)

    it means freedom and a respect for my education, my skills and my hard work.
    read my story below.

    America, the land of opportunity and freedom.

    These days when I hear America being any of the above, I usually
    sneer. 6 long years have thought me not to accept everything I hear.

    Back home, I had respect. I had a good education and a great job. I
    got an education from the best schools and the best colleges. I worked
    for a big multi-national with a big fat salary and lots of
    opportunities to travel to countries on work. I was a success. But I
    wanted to be more. I wanted to be global. I wanted to work in a
    different country for sometime. I loved seeing different cultures,
    seeing different places; I wanted to see the world. Thats when the
    offer for a job in the US came. I took it up because I could see the
    US of A, the land of the free, the land of opportunity, the land of
    the Cisco's and Microsofts and more importantly, the land of dreams. I
    thought a couple of years working away from home would do me no harm.
    Boy, was I wrong!!!!

    The first few years in my new country of residence were difficult. I
    worked for a startup with its crazy hours and insane schedules. Far
    from seeing new places, I was busy at work. But I did not complain. I
    liked the work and the company's passion to create something new. No
    longer was I working on the junk companies outsource to third world
    companies. I was working on the actual product, creating something
    that was not done before, something I could be proud off. I was busy
    at work, but it was not difficult to notice something, the Americans
    worked hard, the people with green card worked harder, but the people
    on H1-B worked hardest. I guess, the people on H1B had the most to
    lose. But I did not give a hoot. I had a product to deliver. I never
    had the time to think about my green card. I still wanted to go back
    to my country, maybe not right now, but I wanted to. Right now, my
    work was my priority and I would concentrate on that.

    Slowly the years went by, and unknowningly I started seeing the
    American Dream. I got a new car and expensive clothes, I started going
    out with my friends, visited new places, and more importantly I
    stopped feeling homesick. The apartment I shared with my friends was
    my new home. So when my company asked me if they could do my green
    card, I readily agreed.

    I should have seen the signs. There were many of them; but I chose to
    ignore. I should have know that people are exploited when I heard a
    top executive at my company say once that he expects everyone to work
    long hours and weekends because we had no options. The job market
    outside was bad and none of us could find jobs. I should have known
    that my cultural background mattered when the girl at the Albertson's
    counter did not even look up to me, but was very friendly with all the
    Americans ahead of me, or when an office colleauge introduced his girl
    friend to all americans but ignored the Indians. I chose to ignore all
    this, because I thought it does not affect me. As long as I did my
    work or followed the rule of the land, nothing else mattered. I was
    wrong again.

    Two things changed in 2005. My company went down and I got married. I
    was on H1B and had to find a job soon. I was already at the end of my
    H1B tenure so not many companies were interested. That is when I
    realized the disadvantage of being on an H1B. It did not matter that
    my resume was impressive. My H1B status was more important than my
    skill set. It it did not matter that I had already spent a lot years
    in this country and my green card had been filed. It was hard finding
    a job that would sponsor my H1B and my green card again. I did manage
    to find one. But I was not lucky on my home front. My wife could not
    work because she was on a dependent visa. She had given up a career in
    India to be with me, but reality hit soon when she started getting
    bored. She kept herself busy with books, TV and cooking. And life went
    on, hoping that we would get our green card soon and we would be free
    again. Free to find a job of my liking for me, and free to do any job
    for my wife.

    Its Feb 2007 now and there's still no sign of the green card. I
    stopped hoping for one. I dont care for one. All I care for now is my
    wife to be able to work in something she likes within any legal
    boundaries.

    Its been a long time since I legally came to this country. I was young
    and succesful then. And now as I cross another anniversary of my
    landing in the US, I reflect upon what I have gained. I have gained a
    big bank balance, a good car, a good lifestyle. What have I lost -
    plenty. I have lost my career, my freedom, my health, my marriage and
    my family. I have been stuck in the same job for many many years while
    all my friends have climbed up the corporate ladder back home in
    India. Its not easy working on an H1B. My marriage has suffered
    because my wife is unhappy that she cannot work, she's close to a
    breakdown, my health has suffered because of all the thinking, and my
    parents have sufferred because I have not been able to take care of
    them. I never have cried so much at my helplessness as I have cried in
    the last one year.

    One thing I have realized about the US is that it is no different than
    any country. Like any other country, the exploitable are always
    exploited. (The big companies are not willing to fight for the welfare
    of their employees. They fight to get more people into the country to
    exploit.) Like any other country, the only thing that gets politicians
    excited is money and votes. (Why do we need so money to lobby the
    politicians? Isn't freedom and justice reasons good enough?) Like any
    other country, it discriminates between the have and the have nots. It
    is a country that has no respect for people. (Ask anyone who goes for
    a visa stamping in the US embassy in India. I have seen old people and
    ladies with small kids spend hours in the hot Chennai Sun to enter the
    embassy for an appointment, just to be spoken rudely by the Visa
    office. There was not even a shelter outside to block the sun. I have
    never seen people turn into US haters so soon). It is a country that
    wants our brains, but is not willing to show a heart.

    Some people may argue that I have the freedom to quit my job and go
    back to my country. But that is not freedom enough. I want the freedom
    to choose when I want to go back. Its not easy to pack 8 years of your
    life in a jiffy. Its not easy to pack 8 years of your life into 2
    suitcases. Neither is it easy to restart your life in a different
    place, even if its your own. It reminds me of an Indian saying -
    "dhobi ka kutta - na ghar ka, na ghat ka". It means, a washerman's dog
    belongs neither to the house nor the river banks. Thats me in a
    nutshell, a "dhobi ka kutta."; a washerman's dog!!!

    ps: I love this country as much as I love my own. But I wish this country loved me back as well.

    If implemented, would this cause audits/additional reviews of already approved I-140s? My 140 was approved in January 2007 in EB2 - Exceptional Ability/Advanced Degree. Hope this does not cause any issues for people like me....

    I am on the same boat, can anyone please clarify?

    I don't know if anyone of you has ever gotten on a rush hour train in mumbai. But before leaving for the US, a wise man told me that going to the US is like getting on a train in Mumbai, it's a struggle to get in. You'll have to push, shove, maybe stand on the footboard for a while. But once you get in, hold on tight until you get to your station.....

    Phew.. I have traveled all three lines(searching for jobs/attending interviews - Early 90s it was not that bright for tech jobs). Still some people standing and reading news papers in that crowd.

    Consider I-485 Processing as a 2 Door Room. Front Door is for people who's PD has been current for the given month and can apply & Back Door is for Adjudicating People who are already applied & still current for that month.

    The size of the room depends on what date they retrogress it to. If Cutoff date is say 2002, there are few people in that room who would be ready for adjudication. Instead if cutoff date is say 2006, there will be a huge number of people in the room.

    As long as you stay in that room for more month (be current), the more chance you have of getting adjudicated fast, but also depends on how many people are ahead of you per RD.


    Assuming that the date is retrogressed from 'C' to 2000 Jan, they start accepting the AOS apps with that PD and then do we assume that they are also working on them or say they donot work on it until the receipt date becomes current.

    If the answer to the question above is 'NO' (that is the receipt date has to become current to adjudicate an AOS app, ofcourse PD has to be current too) then why is that USCIS accepting apps with a specified PD cut off date. In this case I am not looking at the people who are already in the room but am wondering why they are letting more people into the room, particularly when there is no room.

    If the answer to the question above it 'YES', that means PD does play a significant role in the AOS adjudication process when there is retrogression, in my opinion.

    I just spoke with an Immigration Representative of my Senator. She knows me as I met her last year with my employer for my other issue.

    She just informed me that we are (Not only we but whole Congress) shocked with un-precedent action of DOS/USCIS for July VB. Senator's Washington DC office is working on this issue including immediate legislative relief to Employment Based immigration. She is well aware of whole drama of July VB. I am going to call Washington DC Office as well.

    I encourage every one call to their Senator and HR and speak with Immigration Representative. I think first time media and lawmakers have acknowledged the problem of Employment Based Immigration.

    Call make much impact than the email/fax
    Can you tell me who are your senators?

    There was a campaign on wrongful denial in AC21 , there was also letter campaign not sure what happened after that ? It was IV action item too... What was the conclusion ? should we all suffer even if it is a training issue, if they act such nice on letters , then why they act as if there is no form and if AC21 is for real aliens from a real alien world.


    Bigboy - those were good enough to help us reach Ombudsman's office and the result of those campaigns was that the Ombudsman's office now have a page on their website addressing this issue. Not sure how much it is helping though but as such, if anyone is having case problems, they have to contact the Ombudsman because their office is officially supposed into case problems and am sure - they have their liason at the service centers who may monitor such decisions at an individual case level.

    Not quite sure why these things are continuing to happen.

    Do you mean the district court asks cis to compensate candidate??? I have never heard this - wondering!!! Don't think its true!

    If a party wins a case, the court may order a losing party to compensate all expenses associated with the suit. The relevant law is "Equal Access to Justice Act" (EAJA). However, if government changes position and reverses the denial/acts on an application/MTR before court rules in your favor, it's not possible to recover court-related expenses. Court filing fee in federal civil cases is $350 so the bulk of all expenses is usually attorney's fees.

    Hello All,

    NSC --> EB2 I Oct 2006 -->485 June 2007 filer --> LUD on mine 03/03/2009 --LUD and RFE on my wifes 03/04/2009 (RFE email from USCIS says: Current Status: Request for Additional Evidence Sent not sure what it evidence they need, recently we have made name change amendment on EAD for my wife, I am assuming it should be related to that, will wait and see till we can hard copy of RFE)

    Introduces Amendment Aimed at Protecting U.S. CompetitivenessThursday, July 19, 2007

    WASHINGTON� Building on his efforts to protect U.S. competitiveness, U.S. Sen. John Cornyn, ranking Republican on the Immigration, Border Security and Citizenship subcommittee, today introduced an amendment to the Higher Education Reconciliation, currently under consideration by the Senate, which would strengthen employer access to skilled employees.

    �A key part of the American economy is our ability to innovate. Yet, today, our country�s technology companies are facing an impending crisis which requires critical interim relief,� U.S. Sen. Cornyn said today. �USCIS�s announcement this year that the cap for H-1B workers was met in just one day, coupled with the recent July announcement that employment-based visas were no longer available for those with advanced degrees, makes clear that industry needs interim relief today until we can return to comprehensive immigration reform. This amendment will go a long way to help out businesses that are the life-blood of the U.S. economy and I hope my colleagues will join me in supporting it.�

    Specifically, the Cornyn Amendment would allow the Department of State and DHS to �recapture� unused employment-based visas. This is not an increase in employment-based numbers but rather, a direction for the agencies to use all the visa numbers that are available today. These visa numbers will be distributed to nurses and physical therapists and aliens with extraordinary ability, advanced degrees, and needed skills. In addition, the Cornyn Amendment also includes a one-time H-1B increase of 115,000 (up from the 65,000) for FY 2008 only.


    So maybe the H-1B provision killed it??

    no....if u hae been around long enough u know this is how USCIs works...with no regard for Rules...as they are not working for a VOTE BANK.....

    Last year therer was the July VB fiasco..Thisyear its this...no surprises at all...they dont want to follow process...coz OMG that will need effort...just approve those whose files u can lay hands on.....with utter disregard for PDs....

    Thanks to everyone who have already sent emails to Ombudsman. We need to do more to get positive results, please go to: http://immigrationvoice.org/forum/sh...ad.php?t=22182 and send those 4 letters.

    Others who have not yet acted on this, please go to that thread; download the 4 letters and mail them.

    As many people mentioned here and other web sites, the denials are continuing and we need to act now to stop this before it gets even worse.

    When you have these news articles ready...one of the easiest way to circulate them is using a news wire agency.

    I have used http://www.prweb.com/ before for my company news releases. It is free and if you want a broader reach pay $80. It is very effective.

    It is a good idea to release it when something related to immigration is going on in senate or house. During this time, all major news network pickup articles from these wires based on keywords like "immigration, border issue etc"

    So make sure you add appropriate keywords when you do the release.
    Thank you for the suggestion. Having a press release is a good idea when IV does something or any legislative event happens, IV can issue a press release at that time with an opinion.
