    Visa Bulletin suggests that severe cut-off date retrogressions are likely to occur early in FY 2008, which starts on October 1, 2007.

    USCIS to Issue Two-Year EAD for I-485 Waiters at End of June 2008
    The Secretary of the Department of Homeland Security announced on 06/09/2008 that the DHS would start issuing two-year EAD beginning from end of June 2008 for the I-485 filers. Hooray!
    Announcement: "I'm also pleased to announce that we will be extending the validity period of the employment authorization documents that we issue to individuals who are waiting adjustment of status to lawful permit residenture or in colloquial phrase, the green card. Currently, adjustment applications are granted employment authorization documents with only a one year maximum validity. Beginning later this month, we'll start issuing these documents with a two-year validity period for aliens who are waiting adjustment of status if their application is expected to be pending for more than a year. This, again, is eliminating a persistent source of frustration for workers who are here, who have a pending adjustment application but have to go and renew their employment documents every single year. It's going to cut the paperwork there."

    So I had another set of soft LUDs on my approved 140, 485, approved EAD and approved AP today. This was the 4th LUD on my 485 and the 3rd LUD on the rest of the applications in the past week, and I was losing my mind worrying about receiving a denial or an RFE just before my trip abroad, leaving me with not enough time to respond to the RFE.

    So I decided to call Customer Service, and after trying a million options on the voice prompt I finally managed to reach the Nebraska Service Center.

    Upon inquiring about the LUDs with no status change, I was told that it was triggered due to the attorney name change and address change. My address that they had on file was also an old one, from 2 years ago. I have since moved, and done the online AR15 thing and received my EAD at the new address, so I'm not sure why/how the system showed the old address. But anyway, the lady on the phone was kind enough to change it to the new address. I didn't bother asking her if they had received the AC21 letter, I wasn't going to take the risk of having to argue with someone on the phone that switching employers is allowed under the AC21 law, etc. I was just happy to find out that the G28N had processed successfully and that I didn't have to expect a denial or RFE at least in the near future.

    Apologies for the long post, but I thought that my tale might help someone that is getting anxious over a similar situation.

    We are talking about HR 5882,5921 and 6039. Very few people are working very hard to take all of us a step ahead with the GC process and we have lots of hope and we also have direction. Please check with your state chapter lead for latest updates.


    Which bills are you talking about? I read most were dropped from Iraq funding bill that passed recently.

    We are just drifting my friend..no direction..no hope....

    Set up for $50 recurring contribution. Never in my life did I felt so charged up as I did in last few days. Thank you IV for inspiring.

    I feel there is value to creating atleast "paid members only" section in addition to regular free zone, so that quality of dicussion is elevated.

    Then it wont be a non profit organization any more. You can ask for donation but cant force for it.

    Hi All,

    This is a nice thread. Found all the answers I was looking for. Still some lingering doubts in my head::)))

    So, has anyone started working on EAD for their/or spouse's LLC?

    Why cant I work on my H1B instead( for my spouse's company )? That would take away some risk. Wouldnt it??

    Do we need to submit any tax docs( for the new company I would be moving to) when we apply for the AC21 or at any later stage??

    Can someone please answer?

In the last two months, while the priority dates were current for several applicants from India in the EB2 category, the applications with later priority dates and later receipt dates got their I-485 approved by USICS. This has generated a great anxiety among those who have been waiting patiently in the line before them.
    I being one such affected person, is sending you this letter with a ???? as a symbol of my protest and hope that USCIS will deal fairly with all the applicants in the order of priority and receipt dates of their I-485 applications.

    Who ever has got the idea of striking, picketing or hunger strike, it will not work here. Lobbying is the only way out for us. Well I guess someone has taken a cue from Mamta Benerjee. Well it surely works in India but not in United States.

    So lets stick to lobbying and calling the senators and addding members and contributing to help lobbying.

    They clearly broke the law...this is the first time we see the officials at ucsics confirming this and the weekend work. Perhaps, they figured out they need to admit it before they are forced to do so.

    I agree with the posts to a certain extent but the last time we sent mass letters only 5000 letters were collected. A couple of people were responsible for collecting 500-1000 letters each. You can caculate the percentage of letter writers of the who actually sent out the letters.

    We talk about num usa etal.. bear in mind they have lots of resources and volunteers willing to call and write letters. We keep fighting about EB3 Vs EB2, red dots and green dots and other 'important' issues, very few actually make the calls. The ones who work, keep working while others demand answers as to why issues are not fixed, the rest of us just like discussing issues to death on the forums... just my 2 (pick your denomination).

    Volunteers - printed thousands of letters - went to train stations, temples, public places, spent money, time, effort, stamped , enveloped - did everything they could to make the campaign a success but still there were only 5000 letters which in fact showed some results.

    Here is how I came up with that analysis. Last year they made changes to give GC for those stuck in FBI name check if they passed 180 days. So most of the ROW got their GC last year. There were not many labors approved from 2008. So there is no demand from EB2 ROW this year. With the economy going down, not many would get EB1s either. I don't anticipate many EB5s either this year. So major chunk of EB visas will need to come to EB2I/C. Will CIS do that or not is a different story.

    While IV is a big organization with 20K+ members, I haven't seen the transparency, All I have seen is tons of threads being created requesting members to donate money, However Is there any transparency in the way the money is being spent the answer is a Big NO.




    Is IV a big organization ? Yes. Definitely. With more than 20K members it is a big org.

    But what transparency do you or we need about contribution money ?

    Overall I had not seen monthly contribution going more than 2 - 3 K per month in last 3 years. And I think that would be enough to maintain the server and software cost, that too if spend very carefully. Cause we have more threads than contributions and it does costs to maintain and keep servers / Software up.

    Now ask yourself ! ! !

    Do I need to know the expenditure report ? My answer would be NO.

    But.. when AOS(485) is denied, won't the underlying 140 and for that matter labor is also denied?

    Well once the h1b extension is granted - it is not retreated. It means that the person is in h1b status till the h1b expires (My understanding)

    Now if 485 is denied when your h1b expiration's last day - then yes you are definitely out of all statuses

    Such a thing is rare because person either files for h1b extension well before h1b expires or atleast decided he will use EAD

    Issues will arise when h1b has to be extended and person is running out of time on existing h1b and the 140 revoke /485 denial happens (like say few weeks only because person was lazy to file h1b extension atleast 180 days before its expiry and decided to not use premium processing and h1b extension is pending)

    Nothing against EB2 or other, at least let them enjoy the freedom.

    It is really frustrating, because of the mistake by the attorney or stupid company policy etc, people like us with pd 2001 etc waiting on EB3. In my case I had PG with 7 yrs exp when filing, but for the stupid lawyer and company policy. putting aside the original classification of categories, given the present scenario, Not sure what way EB2 is better than EB3

    Paskal is watching you! EB3 deserves this. I am EB3 India 2005, in for a looooong wait for another decade? May be.

    And, BTW is somebody hijacking this thread?!?! Not me, Paskal!

    Does anyone know the process involved in 140 revocation? What is the INS processing fee? How much does an Attorney charge and what exactly do these employers write to USCIS?
