My company has been going through layoffs for the past 3 quarters and are unable to start my GC process. I believe they have to wait for 6 months before they go forward and apply. I am talking about a big company with different departments like operations, marketing and most of the layoffs are happening in these, but recruitment is active in IT. They are regularly recruiting new resources and increasing the head count.
I have following questions:
1) Can my company show that the layoffs are happening in different depts and go ahead and process my GC?
2) What is the risk in doing so.
3) Anyone experiencing a similar situation and could successfully get their GC process started and have approved labor/I140?

Hey all,
I am thinking of starting a company in partnership with an American Citizen. I currently hold H1B visa sponsored by my employer. If i start the company in partnership, can my partner/ my firm sponsor my concurrent H1B once the company is setup? My job will be quite similar to the job profile on my primary H1B.
I know the easiest is to be a silent partner, but in my case i might have to be involved 5-10 hours a week. So i understand concurrent H1B in my case would be the best. Any advise or feedback is greatly apprecaited.

Supposed my I-485 was approved, am I legally required to go to USCIS, surrender my I-94 card and get a I-551 stamp? Could I just wait for GC to come in the mail?
The card is taking just a few days to arrive these days. Just wait for a few more days. You need the I-485 approval notice to get I-551 stamp.
But I'm sure you won't need it.

Hi,
I have I-140 approved(ABC company) and have 5 months left in my first 6 year cycle. I was laid off from the job. A New employer XYZ applied for my H1B extension based on I-140 approval and got approved for 3 years.But I was unable to join
XYZ due to family situation and moved back to India.
Questions:
1. Can a new employer apply for H1B extension based on my I-140 approval even though I am not in USA.? My I-140 has not been revoked or cancelled.

2.Can I claim the remaining time on my H1B approval(based on I-140) with company XYZ ?I have copy of the H1B approval but not sure if it has been revoked.
Please advice.

There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. This is the latest update as of Tuesday, April 6, 2010, Vermont Service Center, as of close of business on Monday, April 5, 2010, VSC had received a total of 9,525 cap-subject H-1B petitions. Of those petitions, 6,791 were "regular" cap, and 2,734 were advanced degree. All cases received before April 7, 2010, will have an April 7, 2010 receipt date. Those received on April 7, 2010 or later will bear the actual receipt date. For those submitted for Premium Processing, the clock will start on April 7, 2010. We will update once we have the California Service Center Numbers.

Hello All,
I need some advice here. Actually I have filed two labors.
Company -A - EB3 - PD of March 2003
Company -B - EB2 - PD of March 2006 (PERM)
I got my Labor, I -140 from company B, and applied for 485 recently (July-2nd).
Recently (Last week) I got the labor approved from Company A (as it went to Backlog).
I was thinking that If I get I-140 from Company A then, My layer wants to use that Priority date in already filed 485 case.
But to get the I-140 from the Company B, I may have to spend around 3k, so just thinking if it is worth doing or not.
Any suggestions?

Today, I was reviewing my I-485 application form and found that Under Part 3 Processing Information, we have to fill-up Place of last entry in United state (City/State):
I put my name there instead of Chicago/IL by mistake. I got I-485 receipt # and case is pending.
How can I correct this information? Is there any way? Please help me.

I just spoke with Xiyun Yang from Washington Post and conveyed thanks for covering a detailed article. She expressed that there is attention being drawn by many quarters including political for "Skilled LEGAL Immigrants".
Also we need to emphasize & communicate is the "increased fees" (almost doubled in many cases) for all USCIS services effective end of this month (July 30). Is this the penalty to be legal ?
The rallys and campaigns should emphasize this important detail too. This is huge money and not fair to the amount of service that is being currently provided.

send them the business week article. In my company along with me 4 other folks also affected due to visa bulletin mess. I sent them an email on July 9th 2007 about flower campaign organized by IV to USCIS director. The sad part is no body showed any interest and bothered to reply. They are also going to benefited by this decision. These people still beleive in Murthy and other lawyer firm updates. I really don't know how to make these folks interested in IV. Any ideas or other personal stories.

Company A filed my I-140 and it got approved, however I have not been provided with copy of the approval notice. I don't have the receipt number either. In this case, is it possible to obtain the copy of I-140 thru FOIA (Freedom of Information Act)?
